According to Polish Civil Engineering Law (Prawo Budowlane Act of 7 July 1994), independent technical functions in civil engineering may only be performed by persons with relevant technical education and professional experience, suitable for the level and complexity of the function, i.e. by persons holding relevant licences, issued by province authorities, i.e. by wojewoda. The term "independent technical functions" covers the following:
- designing and reviewing architecture-and-construction design
- exercising Owner's supervision and Contractor's supervision
- site management and managing other civil works
As a result, designs made by foreign engineers require authorisation by Polish licenced engineers to be accepted by Polish authorities. Otherwise the construction permit may not be obtained. Authorisation involves reviewing the desing in terms of correctness and conformance with Polish standards and regulations.
Polish Civil Engineering Law also governs the project implementation phase. The person acting as a site manager or site supervisor is required to hold a relevant licence, different for civil, electrical and mechanical installations. Otherwise the permit to conduct civil works will not be issued by the authorities.
